​1. Introduction
​These Terms and Conditions ("Terms") govern the provision of residential property management services ("Services") by MAS Lettings & Management Limited ("we", "us", "our", or the "Company") to the landlord or property owner ("you", "your", or the "Client"). By engaging our services, you agree to be bound by these Terms in conjunction with your signed Property Management Agreement.

2. Scope of Services
​Our property management services may include (subject to your chosen service level):​

Marketing and advertising the property

Conducting viewings and tenant referencing

Drafting tenancy agreements in accordance with UK law

Collection and remittance of rent

Property inspections
-
Handling maintenance and repairs
-
Deposit registration with an approved scheme
-
Compliance with legal obligations (e.g., Gas Safety Certificates, EPCs, Fire Regulations)

Coordination of eviction proceedings where necessary

Details of the services included will be specified in your Service Level Agreement.​
3. Fees and Charges​

Our fees will be clearly outlined in your signed Management Agreement. This may be a fixed monthly fee or a percentage of the monthly rent.

Additional fees may apply for specific services such as tenant find-only, refurbishment coordination, or legal proceedings.

All fees are subject to VAT at the prevailing rate, where applicable.

Fees may be deducted from rent collected or invoiced directly.

4. Client Responsibilities
​As the Client, you agree to:

Provide accurate and complete information about the property

Ensure the property complies with all applicable UK housing and safety laws

Maintain suitable landlord insurance
-
Notify your mortgage lender, freeholder, or insurers (as applicable) of your intent to let the property
-
Keep up with any mortgage, ground rent, or service charges related to the property

5. Legal and Regulatory Compliance
​We will act in accordance with UK laws and regulations, including:

The Housing Act 2004

The Landlord and Tenant Act 1985

The Tenant Fees Act 2019

The Deregulation Act 2015
-
Data Protection Act 2018 (GDPR)

You are responsible for ensuring the property complies with all legal requirements, including but not limited to:​

Valid Gas Safety Certificate

Electrical Installation Condition Report (EICR)
-
Energy Performance Certificate (EPC – minimum rating E)
-
Smoke and carbon monoxide alarms (as required by law)

Fire Safety Regulations
-
Selective Licensing (if applicable)

Insurance

6. Deposit Handling
​We will register tenant deposits with a UK government-approved tenancy deposit protection scheme, such as:

7. Rent Collection
You authorise us to act on your behalf in all matters relating to the deposit, including deductions and disputes.​

We will collect rent from tenants and transfer it to you, less any agreed fees or maintenance costs.

We are not liable for non-payment of rent but will pursue arrears and advise on legal remedies.

We may refer persistent arrears to solicitors or debt recovery agents (at your expense, where applicable).

8. Repairs and Maintenance​

We will arrange routine and emergency repairs using trusted contractors.

You authorise us to authorise expenditure up to £[Insert Threshold Amount] without prior approval.

For costs exceeding that amount, we will seek your approval unless urgent action is required for health, safety, or legal compliance.

9. Tenancy Agreements​

We will prepare tenancy agreements that comply with current UK law, usually Assured Shorthold Tenancy (AST) agreements.

We will serve required documents such as the How to Rent Guide, EPC, and gas safety certificate, and register the deposit.

10. Term and Termination​

This agreement will continue until terminated by either party with two months written notice.

If termination occurs during a fixed-term tenancy, early termination fees may apply.

Upon termination, we will hand over all documents, keys, and tenant information to you or your nominated agent.

11. Liability and Indemnity​

We are not liable for losses due to tenant negligence, non-payment, property damage, or changes in legislation.

We will not be responsible for any delay or failure in carrying out our duties caused by factors beyond our control.

You agree to indemnify us against all claims, costs, and expenses incurred due to your breach of law or contract.

12. Data Protection​

We will process your and your tenants' data in accordance with the Data Protection Act 2018 and UK GDPR.

13. Dispute Resolution​

Any disputes arising out of or in connection with this agreement will be resolved through negotiation in good faith.

If unresolved, disputes may be referred to the property redress scheme.

14. Governing Law​
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
​
15. Amendments​
We reserve the right to amend these Terms with reasonable notice. Continued use of our services constitutes acceptance of any updated Terms.
